Membership Eligibility, Rights & Privileges:
- By signing this agreement, the member confirms that they meet all eligibility requirements for membership as outlined by the facility.
- The member is entitled to access and use the facilities and services provided by the facility in accordance with the terms of this agreement.
- Membership rights and privileges may vary depending on the type of membership purchased.
Company Policies:
- Activation of membership - The membership is automatically activated the next day as per date of payment of membership fees.
- Membership Transfer policy – Membership can be transferred to a non-member as well as to another Crunch location in India
i. Inter Gym transfer-

Case 1 – In case, a member from Club “A” uses any other gym of Crunch in different territory continuously for one month, his membership would automatically be terminated from Club A and transferred to
the other gym which he has been using for last one month.

Case 2 – Voluntary Transfer, if a member of Club “A” wants to get the membership transferred to Club “B”, Rs. 1000 plus GST will be charged as transfer fees at Club “A” and balance period membership
fees shall get credited to Club “B”.
ii.Member to Non-member – Membership at the same location can be transferred only to non-members at a nominal charge of Rs. 1000 plus GST.
iii. Transfer frequency – Members are limited to 1 gym transfer per year, unless they want to cancel and rejoin.

Access to other Crunch locations – The membership allows temporary use/ access to other Crunch facilities in the country, however utilizing the facility beyond 30 days shall be deemed as default
transfer as per membership transfer policy. Also, the temporary usage of R&R at other locations must also be done via reservation on the app (subject to availability of time slots)

Membership Upgradation – Membership can be upgraded as per given timelines. o Monthly – 7-10 window shall be available to upgrade membership o Quarterly Membership – 15 days window shall be available
to The membership allows temporary use/ access to other Crunch facilities in the country, however utilizing the facility beyond 30 days shall be deemed as default transfer as per membership transfer policy.
Also, the temporary usage of R&R at other locations must also be done via reservation on the app (subject to availability of time slots)upgrade membership o Half yearly – 30 days window shall be available to
upgrade membership

Extension - Brand follows a no membership freezing or extension policy. However, extensions can we granted in exceptional cases as under: o Medical reasons – 30 days extension, medical certificate to
be submitted for company’s records. o Pregnancy – 9 months extension max.
- Cancellation/Refund – Brand follows a no cancellation/refund policy.
Membership Fees and Payment Terms:
- The member agrees to pay all applicable membership fees, including initiation fees, monthly or annual dues, and any additional charges for special services or amenities.
- Membership fees are non-refundable and non-transferable except as expressly provided in this agreement.
- Payment must be made by the due date specified in the membership agreement. Late payments may result in penalties or suspension of membership privileges.

Charges and fees for services and facilities are subject to change as deemed necessary by the Club. The Club reserves the right to withdraw any complementary services offered to club members without given
prior notice at its discretion
Membership Renewal and Termination:
- Membership may be renewed upon expiration subject to payment of applicable renewal fees and compliance with the terms of this agreement.
- The facility reserves the right to terminate or suspend membership at any time for breach of this agreement or violation of facility rules and regulations.
- The club holds a right to reserve "RIGHTS OF ADMISSION" & reserves the right to "TERMINATE A MEMBERSHIP" as and when the management deems necessary.
- Former members and members restricted from the Club may not enter as guests.
General Policies & Procedures:
- The member agrees to abide by all facility rules and regulations, including but not limited to rules regarding conduct, safety, hygiene, and facility usage.
- Failure to comply with facility rules may result in disciplinary action, up to and including termination of membership.
- The Club shall not be responsible or liable for any loss or damage to any property of members or their guests, including their automobiles and contents.

Any member who displays unruly, disrespectful, bothersome, offensive behaviour to other members or behaves otherwise in an unbecoming manner or who is cited for infraction of rules and regulations may be
suspended or expelled from the Club on immediate basis. In the event of termination. the unused portion of membership fees shall be refunded to the member on prorate basis.
- Hours and days of operations are posted at the Club and are subject to changes as Club utilization dictates. The Club will remain closed on public holidays & once a month for maintenance.
- The club is NO SMOKING Zone. Those found disobeying this norm shall face repercussions/ consequences/ Expulsion.
- Its mandatory to mark attendance manually in the event of technical failure/fault in the access control devise.
- The Club is not responsible for Lost and Found items. Items found are immediately placed in public lost-and-found location.

Photographic, video or related equipment are not allowed on the premises. Photography is strictly forbidden. Special permission in writing from the club management shall be required for individuals seeking
access to photography/videography for promotional purpose/intent.
- Music played in the gym will be maintained at a standard decibel. Selection of music will be at the discretion of the management only.
Facility Rules and Regulations:

Members must wear proper attire covering the body. Members are not allowed to remove T-Shirts at the gym floor. The Club reserves the right to refuse anyone who is not properly attired and/or personally
clean.
- Avoid wearing clothing with offensive or inappropriate graphics, slogans, or imagery that may offend or distract others.
- R&R sessions can be accessed via reservation only, as per availability of time slots on the Crunch mobile app. Reservations can be done for a maximum of 3 consecutive days via the Crunch app as per time slot availability.
- Maximum 1 slot per day per member. Multiple bookings not permitted.
- R&R Reservation cancellation: Member can cancel the reservation at least 24 hrs prior to the chosen time slot.
- R&R reservation - No-Show Penalty: The session stands cancelled and amount shall be forfeited.
- Return weights to proper racks when finished.
- Seek assistance from professionals / trainers when using heavy weights. No dropping the weights.
- Keep the premises clean. Do Not litter or leave debris on the gym floor.
- Members who sweat profusely are asked to use towels when using the equipment.
- Shaving in the gym is strictly forbidden.
- Eating and drinking is not permitted in the Gym premises.

Members are not permitted to leave their belongings anywhere in the gym premises including lockers as lockers can only be used during the duration of workout. Belongings may not be left in daily lockers
overnight. Locks will be cut off and contents removed. The Club does not accept responsibility for items lost.
- No personal belongings (i.e. gym bags, purses, extra clothing, cell-phones, etc.) are allowed in the workout areas.
- No member shall solicit or perform personal training services on the premises. No external personal trainers will be allowed to work out in the gym.
- Members can carry out their own workout pattern at their own risk. Management is not responsible for any accidental damage caused due to unadvised exercise routine.
- Footwear must be worn at all times in the entire Club. Socks and sandals are not allowed. Street shoes are not allowed. Members must therefore carry 1 pair of shoes for accessing the club.
Supervision and Minors
- Children below 14 yrs of age shall not be permitted to workout at the gym expect events (if any) organized for kids.
- Children under 17 yrs must work out/practice under Parental/professional supervision.
- Parents or guardians are solely responsible for supervising minors and ensuring their compliance with facility rules and guidelines.
- Children under 17 yrs of age can access the facility only when the parents have submitted duly filled & signed Minor Consent waiver.
Liability Waiver and Indemnification:

The member acknowledges and assumes all risks associated with using the facility and agrees to release, indemnify, and hold harmless the facility and its staff from any liability for personal injury, property
damage, or loss arising from their participation in facility activities.
- The member agrees to bear all costs and expenses incurred as a result of any injury or damage caused by their actions or negligence while using the facility.

Any damages to Crunch facilities or property or the property of any members caused by another member or his/her guest, is the sole responsibility of the offending member. All costs of damages and repairs will
have to be borne by the offending member. In case the member does not compensate the Club for the same within 15 days from the date of written notice the membership will be terminated and fees paid for
membership or other services or facilities will be forfeited. Additional amount over the amount forfeited will have to be borne by the member.

You (Buyer, each member and all guests) agree that if you engage in any physical exercise or activity or use any Club facility on the premises, you do so at your own risk and assume the risk of any and all
injury and/or damage while engaging in any physical exercise or activity or use of any club facility on the premises. Your assumption of risk includes, without limitation, your use of any exercise equipment
(mechanical or otherwise), the locker room, Sidewalk, parking lot, stairs, steam room, area, or any equipment in the Club facility. Member agrees to assume the risk in his or her participation in any
activity, class, program, instruction, or Club-sponsored event You agree that you are voluntarily participating in the aforementioned activities and using the Club facilities and premises and assume any risk
of injury, illness, damage, or loss to you or your property that might result, including. without limitation, any loss or theft of any personal property or even death. You agree on behalf of yourself (and all
your personal representatives, heirs, executors, administrators, agents. and assigns) to release and discharge Club (and our affiliates, employees, agents. representatives, successors, and assigns) from any
and all claims or causes of action (known or unknown) arising out of the negligence of Club, whether active or passive, or any of its affiliates, employees. agents, representatives, successors and assigns.
This waiver and release of liability includes, without limitation, injuries which may occur as a result of (a) your use of any exercise equipment or facilities which may malfunction or break, (b) Club's
improper maintenance of any exercise equipment or facilities, (c) Club's negligent instruction or supervision, including personal training, and (d) you slipping and falling while on the facility or any
portion of the premises for any reason, including Club's negligent inspection or maintenance of its facility ay execution of this agreement. you hereby agree to indemnity and hold harmless Club from any loss,
liability, damage. or cost Club may incur due to your presence at the Club facility. You further expressly agree that the foregoing release, waiver, and indemnity agreement is intended to be broad and
inclusive as permitted by the law in the Courts of India and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect, The
Customer acknowledges that the redressal of any liability arising out of any claims made including claim for damages and mental agony or refunds sought in respect of membership obtained by the customer from
the Franchisee of Crunch shall solely be the responsibility of . franchisee. The Franchisor of Crunch shall bear no liability towards any such aforementioned claims. The customer agrees and acknowledges that
it has sought the membership of the gym after satisfying itself of the facilities offered by the franchisee and not merely on the basis of the brand Crunch. YOU ACKNOWLEDGE THAT YOU HAVE CAREFULLY READ THIS
WAIVER AND RELEASE AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY, AND EXPRESS ASSUMPTION OF RISK AND INDEMNITY AGREEMENT. YOU ARE AWAREAND AGREE THAT BY EXECUTING THIS WAIVER AND RELEASE, YOU ARE
GIVING UP YOUR RIGHT TO BRING A LEGALACTION ORASSERT A CLAIM AGAINST CLUB FOR ITS NEGLIGENCE, OR FOR ANY DEFECTIVE PRODUCT ON ITS PREMISES. YOU HAVE READ AND VOLUNTARILY SIGNED THE WAIVER AND RELEASEAND
FURTHERAGREETHAT NO ORAL REPRESENTATIONS, STATEMENTS, OR INDUCEMENTAPART FROM THE FOREGOING WRITTEN AGREEMENT HAVE BEEN MADE. Vil. SEVERABILITY

These provisions of this contract are severable and if any provision is determined to be illegal or unenforceable, the remaining provisions and any partially enforceable provisions shall nevertheless be
enforceable. The Club's failure to enforce any remedy or provisions in this contract shall not be constructed as a waiver of such remedy or provision.
Renovation & Temporary Closure
- The facility reserves the right to make renovations, improvements, or alterations to the facility, including but not limited to changes in layout, equipment, amenities, or operating hours.
- Members will be notified in advance of any planned renovations that may impact their access to or use of the facility.
- The facility will provide members with estimated timelines for completion of renovations and updates on progress as necessary.
- Members are expected to cooperate with facility staff and adhere to any temporary changes or restrictions implemented during renovations.

The facility shall not be liable for any inconvenience, loss, or damages incurred by members as a result of renovations, including but not limited to temporary closures, changes in services, or disruptions to
facilities.
- Members acknowledge and accept the inherent risks associated with facility renovations and agree to hold the facility harmless for any related inconveniences or disruptions.
- The club will keep the premises shut temporarily if there is a need arising out of an emergency situation taken place in the premises or in the neighbourhood as it deems necessary
Privacy Policy:
- The facility respects the privacy of its members and will handle personal information in accordance with applicable privacy laws and regulations.
- The member consents to the collection, use, and disclosure of their personal information for the purposes of administering their membership and providing facility services.
- The club shall remain under CCTV surveillance as a safety hygiene.
Dispute Resolution:
- Any disputes arising out of or relating to this agreement shall be resolved through arbitration in accordance with the rules of the governing act.
- The prevailing party in any dispute shall be entitled to recover reasonable attorney fees and costs incurred in connection with the dispute.
Amendment and Governing Law:
- This agreement constitutes the entire agreement between the member and the facility and supersedes all prior agreements and understandings, whether written or oral.
- This agreement may be amended or modified by the facility at any time with notice to the member.
- This agreement shall be governed by and construed in accordance with the government laws , without regard to its conflict of laws principles.
Acknowledgment and Acceptance: - By signing this agreement, the member acknowledges that they have read, understood, and agreed to all terms and conditions outlined herein.
